Rental contracts in Dubai are not considered finalized until they are registered with Ejari. This service is crucial in protecting the interests of all parties engaged in the tenancy agreement. A normal Ejari registration lasts a year and may be renewed annually. Tenants, on the other hand, have the option of terminating their rental agreement at the end of the term or even earlier. WHEN CAN I CANCEL AN EJARI IN DUBAI?

It is possible to terminate your Ejari contracts, whether you are a tenant or a landlord. There are two approaches to this:

  • Early rental contract termination
  • If the parties do not choose to extend the contract at the conclusion of the lease, the contract is cancelled.

Your Ejari contract will not be automatically terminated when it expires. In fact, if Ejari is not terminated, it will be impossible for you to migrate to another location/property as a tenant or lease your property to a new party as a landlord!

According to RERA law, a property should only have one Ejari registration. As a result, landlords must terminate the Ejari as soon as the renter walks out.

EJARI CANCELLATION PROCEDURE: HOW TO CANCEL EJARI

Ejari can be cancelled through the Real Estate Trustees Centre and the app. Let’s have a look at both possibilities.

DOCUMENTS REQUIRED FOR THE CANCELLATION OF EJARI THROUGH THE REAL ESTATE TRUSTEES CENTRE

You will need the following to cancel Ejari:

  • Emirates ID for both parties
  • Certificate from Ejari
  • The passport of the tenant
  • The landlord’s No Objection Certificate (NOC)
  • The tenant’s most recent DEWA bill
  • Original tenancy agreement
  • A letter of termination from the property owner

If the renter is a corporation, you have to provide the Emirates ID and trade license for both the owner and the manager.

You must also send a copy of your Ejari certificate. If the Ejari certificate is unavailable, you can replace the tenancy contract.

The following information should be included in the Ejari cancellation NOC letter:

  • Name of the landlord
  • Building title
  • DEWA premise number
  • Plot number
  • Personal information of the tenant
  • A statement of vacancy
  • Signature of the landlord (matching the signature on his passport)
  • The company seal (if the landlord is a company)

The submission of the final DEWA bill is the most important stage in the Ejari cancellation procedure. If there are any outstanding DEWA invoices, the cancellation procedure is still incomplete.

If you send a physical copy of the bill, the words ‘Final Bill’ and ‘Paid’ should be clearly stamped. You can also submit a copy of the “Green Bill,” which can be found on the DEWA website.

Other documentation may be required in unusual circumstances. For example, if the property was sold during the tenancy period and the buyer took over the lease, you must provide the title document. If the new owner is not a UAE resident, they must additionally produce a copy of their Emirates ID or a valid passport.

Assume a landlord’s representative also signed the tenancy agreement. In such instance, they must additionally produce a Power of Attorney authorizing the representative to sign the lease on the owner’s behalf. In addition, the representative must provide their Emirates ID, residence visa, or passport.

HOW TO CANCEL EJARI ONLINE

There are several options for canceling Ejari online. You can choose from the following options.

TRUSTEES CENTRES FOR REAL ESTATE SERVICES

  • Visit the Real Estate Services Trustee Centres (also known as Ejari Cancellation Centres).
  • Submit the necessary documentation.
  • Wait for the transaction data to be verified and approved.
  • Pay the fee and obtain a receipt.

DLD WEBSITE

You can also cancel your Ejari through the Dubai Land Department. To begin the service, complete these steps:

  • Visit the website of the Dubai Land Department (DLD).
  • Choose the “Services” tab.
  • Select “Tenant” from the drop-down list.
  • Click on “Real Estate Rental Services”
  • Click on “Request for Cancellation of Ejari Contract”
  • On the upper left, click “Access this Service” (the “green” tab).
  • Log in as an owner/tenant/individual/business user to your DLD account.
    • Enter your Emirates ID or your user name/password (for business users).

    • Enter your Emirates ID, cellphone number, title deed, or email address (for owners, tenants, or people).

You can also do the following:

  • Login with UAE Pass
    • To login, enter your cellphone number/Emirates ID/email address.
    • Continue with the procedure completion.

VIA THE DUBAI REST APP.

The DLD REST app is another option to cancel Ejari online. You must do the following here:

  • Register for or log in to the Dubai REST app.
  • Please include all necessary information.
  • Please provide any needed documentation.
  • Submit your application.
  • Wait for the feedback. If your request is granted, you will be notified by email.

WHAT IS THE COST TO CANCEL EJARI?

The cancellation charge for Ejari varies based on the method you pick. It is completely free to apply using the app. It will, however, cost you AED 40 (excluding VAT) to cancel it through Real Estate Services Trustees Centres.
